Q. In the light of the Government of National Capital Territory of Delhi Act of 2021, do you think that the Central government has usurped the power of the elected government of Delhi?

Ans: 

The 69th amendment to the Constitution has added Article 239AA and 239AB and created a legislative assembly for the Union Territory of Delhi with a council of ministers. It has given authority and power to legislate on all subjects of List II except law and order, land, and police. 

  • The Government of the National Capital Territory of Delhi holds popular sovereignty. It means the legislative assembly is elected by the people of Delhi to govern them. The Government of the National Capital Territory of Delhi Act of 2021 has made changes in the Government of the National Capital Territory of Delhi Act of 1991. It says that the government of Delhi means LG of Delhi. 

  • The GNCTD Act, 2021 empowers the LG to reserve the bill passed by the legislative assembly. The Act says that all executive action, whether taken on the advice of the Minister or otherwise, must be taken in the name of LG. It says that certain executive action must be initiated with the prior recommendation of the LG.  

  • The Central government, through the GNCTD Act of 2021 and the LG, has usurped the power of the Delhi Legislative Assembly in their own hand. It empowered itself through this act to put obstacles in any legislative or executive work of the Delhi government. 

 

The GNCTD Act has empowered the Central government so much so that the Delhi Legislative Assembly may turn into a toothless institution, elected but powerless to do work freely for the people of Delhi.
