Probity in governance highlights the strong sense of honesty and integrity in administrative affairs. It seeks to achieve high moral and ethical values in governance and seeks to ensure socio-economic upliftment of the masses.

Its relevance in the Indian setup:

For economic equality- According to an Oxfam report in 2017, 10% of the Indian population holds 77% of national wealth.

Corruption Free state- According to transparency International report 2020, India records highest rate of bribery in Asia.

Job creation- India is witnessing a job crisis and here with schemes like skill India government is trying to bridge the gap but have miles to go.

Environmental efforts- India is the 5th most polluted country and probity in governance will be helpful to tackle this situation.

According to Justice H.R. Khanna report below are the methods to ensure probity in governance:

Need to enforce section 5 of the Benami Transaction (Prohibition) Act, 1988, which talks about property acquisition.

Misfeasance in public office where the Apex court held that the “Public servant should be held personally responsible for their malafide acts in the discharge of their functions as public servant”.

The Supreme court in Delhi Development Authority Vs Skipper Com Pvt. Ltd. held that the properties acquired by the public servants need to be confiscated and the culprit should be punished.

Social audit should be promoted to ensure participatory democracy.

Probity in governance is the major prerequisite to ensure effective democratic principles in society and for the development of marginalised sections of the society.
